These Terms of Service ("Terms") govern your use of the Penwell mobile application and related services ("Service") operated by Vargas Solutions ("we," "us," or "our"). By using Penwell, you agree to these Terms.
Penwell is an AI-assisted greeting card platform that enables you to create and send personalized multimedia greeting cards — including photos, videos, and AI-generated narratives — to recipients via various channels including SMS, MMS, and iMessage.
You must be at least 13 years old to use Penwell. You sign in using Apple Sign in with Apple and are responsible for maintaining the security of your account.

When you send a greeting card, the recipient receives a message from our number (707) 736-6363. By using the send feature, you confirm that you have a personal relationship with the recipient and a reasonable basis to believe they would welcome the message.
Message frequency: Message frequency varies. Recipients receive messages only when a Penwell user specifically creates and sends them a card. This is not a recurring subscription.
Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opt-out: Recipients can reply STOP to opt out of future messages at any time.

Mobile information and SMS consent are handled as described in our Privacy Policy — no mobile information is shared with third parties or affiliates for marketing or promotional purposes. Full messaging program details are published in our SMS Policy.
You retain ownership of photos and text you provide. AI-generated narratives are created for your personal use. You grant us a limited license to process, store, and transmit your content as necessary to provide the Service.
Penwell uses AI (Anthropic Claude) to generate personalized narratives based on your input. While we strive for quality, AI-generated content may occasionally contain errors. You are responsible for reviewing content before sending.
The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months prior to the claim.
We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
